Premium Processing Service to Resume – (05/29/20)
Premium Processing Service (PPS) for Form I-129, Petition for a Nonimmigrant Worker and Form I-140, Immigrant Petition for Alien Workers will resume in phases over the next month. USCIS announced that it will begin accepting the Form I-907, Request for Premium Processing Service on the following schedule:
- Effective June 1, 2020: All eligible Form I-140 petitions.
- Effective June 8, 2020: Form I-129 petitions (including O and P petitions) for nonimmigrant classifications eligible for premium processing filed before June 8 that are pending adjudication. In other words, already-pending O and P petitions can be upgraded, but newly filed petitions after June 8 will have to wait for requesting PPS until June 22.
- Effective June 22, 2020: All other Form I-129 petitions (including O and P petitions) for nonimmigrant classifications eligible for premium processing and requesting premium processing by filing an I-907 concurrently with their I-129.
As USCIS begins resuming PPS requests, these dates may be subject to change and will be announced accordingly, if that is the case. Petitioners who had already filed Form I-129 or Form I-140 using the premium processing service before the March 20 suspension, but received no action and a refund, may refile their Form I-907 consistent with the timeline above.
