P-3 Filing Specifics
P-3 petitions may be organized in the same fashion as O-1B petitions in the case of a single beneficiary, or O-2 or P-1B petitions for multiple beneficiaries. As with the P-1B, there are no special forwarding procedures and petitioners may not use prior labor consultation letters. Remember to include in the appropriate spot an alphabetized beneficiary list. The documentary requirements are simpler than for O-1B or P-1B petitions, but include contracts, itinerary, supporting affidavits, testimonials, or other materials respecting authenticity and cultural uniqueness.
As of April 1, 2024 the maximum number of beneficiaries that can be listed on an O-2, P-1B, P-3, or P-S petition is 25. P-1B/P-2/P-3 beneficiaries appearing on the same petition (up to 25 on one petition) must be members of a group. Be careful to keep track of which beneficiaries are being grouped together for each separate petition and make sure that all the other information regarding the classification period requested and supporting evidence for the group as a whole is identical. When a group petition requires being separated into multiple forms due to the 25 beneficiaries cap, these related petitions may be filed in one mailing (envelope) but each grouping must contain all supporting documentation (i.e. each must have its own cover letter, itinerary, evidence, copy of labor union consultation, etc. and separate check for filing fee).
